How should judges deal with the manifestation of religious symbols in public educational institutions? In light of the important role of human rights in our legal and political system, courts should grant maximum protection under the freedom of religion or belief. The central thesis of this article is that the European Court of Human Rights fails to live up to this standard. In order to reach this conclusion, the article analyzes relevant case law of the European Court and compares its (...) case law with that of the high courts of Canada and South Africa. In addition, the article assesses the case law of all three courts from the angle of interpretation theory and particularly Cass R. Sunstein’s theory of judicial minimalism. Adoption of a more consistently minimalist methodology by the European Court might lead to a greater protection granted to individuals and groups. However, a wide and deep ruling is first required to overturn the current line of reasoning. The European Court can draw inspiration from Canada and South Africa for such a judgment. (shrink)

This paper presents a generalization of the standard notions of left monotonicity (on the nominal argument of a determiner) and right monotonicity (on the VP argument of a determiner). Determiners such as “more than/at least as many as” or “fewer than/at most as many as”, which occur in so-called propositional comparison, are shown to be monotone with respect to two nominal arguments and two VP-arguments. In addition, it is argued that the standard Generalized Quantifier analysis of numerical determiners such as (...) “more than three/at least three” is a simplification which ignores the fundamental parallellism with the propositional comparatives. Furthermore, the symmetric monotonicity configurations of the existential “some” and “no” are shown to be straightforwardly related to those of numerical comparatives with the limit numeral zero, whereas the asymmetric configurations of universal “all” and “not all” involve the extra complicating mechanism of polarity reversal, which is related to Keenan's notion of co-intersectivity (as opposed to intersectivity). A second aim of the paper is to investigate some of the factors reducing the inferential potential of determiners. Different types of comparative determiners and their modification will be considered in detail. In addition, a systematic interaction will be revealed between the monotonicity properties of the determiners in propositional comparatives and the differ ent types of ellipsis in the “than”-complement. Different degrees of ellipsis are defined in terms of informational dependencies between the “than”-complement and the main clause. A general balancing mechanism is observed by virtue of which an increase in informational dependency is compensated by a reduction of the inferential potential of the comparative determiner. The structure of the paper is as follows. Part two deals with propositional comparison and introduces the two basic monotonicity configurations. Part three distinguishes three types of informational dependencies or ellipsis between the “than”-complement and the main clause. In Section 3.1 the “than”-complement only contains a VP constituent, whereas in Section 3.2. it only consists of a nominal constituent. Section 3.3 considers more complex instances of multiple dependencies. Section 3.4 then looks at the interaction of these three types with the modifier “proportionally”. Part four presents the two basic monotonicity configurations for numerical comparison, whereas part five deals with more complex numerical determiners. Bounding determiners, such as “between five and ten”, and other boolean combinations are discussed in Section 5.1, whereas Section 5.2 goes into approximative determiners involving modifiers such as “only” or “almost”. Section 5.3. is devoted to proportional determiners such as “more than two out of three”. Part six then considers the standard existential and universal quantifiers. Computers were invented recently to mechanize tedious manual informational procedures. Such procedures were themselves invented only during the last ten millennia, as agricultural civilizations outgrew village-scale social instincts. The instincts arose in our hominid ancestors during several million years of life in the wild, and were themselves built on perceptual and motor mechanisms that had evolved in a vertebrate lineage spanning hundreds of millions of years.

In May 2017, my book ‘Conversations on Art and Aesthetics’ appeared. It contains conversations with, and photographic portraits of, ten prominent philosophers of art. They are Noël Carroll, Gregory Currie, Arthur Danto, Cynthia Freeland, Paul Guyer, Carolyn Korsmeyer, Jerrold Levinson, Jenefer Robinson, Roger Scruton, and Kendall Walton. The book has two main aims. One is to provide a broad and accessible overview of what aesthetics as a subfield of philosophy has to offer. The other is to stimulate new work in (...) this area of research. In this brief paper I’d like to say a bit more about this second objective. Current research is rarely conducted or communicated in the form of conversations, so the question arises: how can a book like mine fit with and feed into a research culture which is very much dominated by the format of the journal article? Im Gegensatz zur verbreiteten Auffassung über die Voraussetzungen zur Ausbildung neuen Wissens entstehen wichtige Umstellungen im Denken häufig nicht durch harte Konfrontation zwischen Hypothesen bzw. Theorien. Vielmehr sind oft allmähliche Deutungsverschiebungen bei der Auffassung einer einzigen Hypothese bzw. Theorie zu beobachten. Derartige Prozesse erstrecken sich in der Regel über vergleichsweise lange Zeiträume und sind nicht wie die erstgenannten Vorgänge von eher kurzfristiger Natur. Verglichen mit dem Ausgangspunkt der jeweiligen Entwicklung tritt uns aber eine oft an ihrem Ende tiefgreifend veränderte Wissenssituation (...) entgegen. Infolge der Langsamkeit der geschilderten Entwicklungen und der damit zugleich gegebenen Gewöhnung ihrer Vertreter an die geänderte Situation sind derartige Veränderungen des Wissens selten in einem Ausmaß vom Bewußtsein der Neuheit begleitet, wie dies bei Vorgängen der zuerst geschilderten Art der Fall ist. Trotzdem können aber gerade diese Veränderungen nachhaltiger und von grundlegenderer Art sein als jene. In der Folge sollen die beiden angedeuteten Wege der Erkenntnis hinsichtlich ihres strukturellen Unterschieds klarer erfaßt werden. Unterschiedliche Annahmen über die zugrundeliegende Ontologie sind für diese beiden Arten der Wissensbildung von besonderem Interesse. Insbesondere wird sich auch zeigen, daß die bereits in der Fristfrage berührten pragmatischen Gesichtspunkte eine wichtige Rolle spielen. Die beiden in dieser Untersuchung herauspräparierten "Wege" sind Aspekte jeweils eines Erkenntnisprozesses. So sind sie nicht gegeneinander auszuspielen. Niniejszy artykuł traktuje o derywacji i jej stosunku do gramatyki. Zwykle derywacja postrzegana jest jedynie jako proces tworzenia słów i jako taka stawiana jest w opozycji do fleksji, którą z kolei badacze jednomyślnie uważają za mechanizm pełniący funkcję tworzenia form gramatycznych. Można jednakże wykazać, że derywacji nie należy redukować tylko do wyżej wymienionej roli, gdyż bierze ona udział również w tworzeniu jednostek gramatycznych. Różnica między derywacją a fleksją polega na tym, że derywacja prowadzi do powstania niezależnych i autonomicznych jednostek, podczas (...) gdy fleksja tworzy jednostki językowe nie mogące występować samodzielnie, czyli poza poszczególnymi kontekstami. Autor zaznacza, że fleksja, która znajduje swe odbicie w formach, mając w ten sposób wydźwięk czysto gramatyczny, różni się od derywacji, która powoduje słowa będące zarówno gramatyczne, jak i leksykalne. Cambridge, Cambridge University Press, 2022. 288 pp. Cloth, $99.99The legendary debate between Ernst Cassirer and Martin Heidegger in Davos, where the two philosophers met and exchanged views on the occasion of the second Davoser Hochschultage in 1929, has been investigated and commented upon many times. The general (...) tenor of these assessments was, as Simon Truwant states, to conclude either that the young Heidegger won out over his elder contemporary Cassirer, or that in fact they talked past each other, that is, that there was no real debate at all. Truwant sets out to contest both of these conclusions, and he fully succeeds in doing so. What may appear as an unnecessary rehearsal at the beginning reveals itself as a balanced and in-depth assessment of the two philosophical projects of the mature Cassirer and the early Heidegger from within and, more broadly speaking, as the expression of a "parting of the ways" (Michael Friedman) in early twentieth-century Western philosophy.Truwant identifies three core topics in the dispute between the two thinkers: first, their assessment of the core of Kant's transcendental philosophy; second, their stance on the human condition; and third, their position toward the proper task of philosophy. Accordingly, the book with its altogether ten chapters is meaningfully divided into three parts. In each part devoted to each of the three topics, a meticulous and close reading of Cassirer's philosophy of human culture qua philosophy of symbolic forms and Heidegger's existential ontology toward being and time is carried out. As the debate advances from an assessment of Kant's critical project, as exposed in his Critique of Pure Reason, to their takes on the essence of the human condition, and finally to the proper task of philosophy, their respective positions more and more appear to become incompatible. This is to be expected, Truwant argues, since each one's stance toward the task of philosophy determines his view on the human condition and, in turn, his interpretation of Kant's transcendental philosophy.This short review is not the place to enter into the carefully exposed argumentative details of Cassirer and Heidegger's views. Suffice it to say that Truwant successfully demonstrates that neither of the above-mentioned standard accounts of the Davos debate can be substantiated. Heidegger did not outmatch Cassirer. Both philosophers argued from an internally consistent position. Cassirer saw the task of his philosophy of symbolic forms as a cosmopolitan one that ultimately strives toward a self-understanding of human culture in all of its facets. He looked at the [End Page 562] human condition from the perspective of mankind as a species of living beings capable of creating a multiplicity of symbolic forms, from myth to language to science, from religion to economy to politics, and he saw the essence of human culture in precisely this irreducible multiplicity that offered the human being a route to transcend its finiteness. At the same time, he shared with Kant the idea that the sciences offer a privileged perspective for the assessment of man's proliferating symbolic capacities, and he held with Kant that our takes on the world are never immediate but always, and necessarily so, mediated by the means with which we approach it. Heidegger, on the other hand, saw the task of his existential ontology to recuperate the fundamental meaning of the being of beings (das Sein des Seienden) that tended to be forgotten (Seinsvergessenheit) both in the course of the history of philosophy and in the busyness of everyday life. He looked at the human condition as being fundamentally finite, and he articulated the necessity to come to terms with its finitude. This article explores the connections between Nietzsche’s Also Sprach Zarathustra and Tove Jansson and the world of the Moomins. It begins with a short summary of the impact of Nietzsche in the Nordic countries and of his most important book, focusing on passages that are of particular relevance for the analyses that follow. It then proceeds to explore its meaning and significance for Jansson in three sections. The first concerns Atos Wirtanen, the writer and politician with whom she lived for (...) ten years, and who encouraged her to publish her first book, while he himself was completing a book on Nietzsche. In the second section, the article analyzes an early semi-autobiographical literary experiment from the Jansson family archive that displays her as a passionate reader of Nietzsche long before her meeting with Wirtanen. In the third and last section, the framework of the Zarathustra narrative is used to interpret some of the figures and scenes from the Moomin books. (shrink)

In the spring of 1980 everyone in China wore the blue Mao uniform; the Cultural Revolution had been terminated a year before and the “Let 1000 Flowers Blossom” campaign introducing economic and cultural diversity and personal responsibility had just gotten off the ground. Ten lines of bicycles in each direction respectfully gave way for the few official, window-curtained limousines of the Red Flag or Shanghai type. Cadres and academics were interested in keeping up with what had happened in the rest (...) of the world during the three decades of Chinese self-isolation during the Civil War first and the Cultural Revolution thereafter. In the fall of 1985 the dresses were more colorful, and Beijing experienced lovers walking hand in hand, cadres preferring Nissan compact cars without curtains over full-sized, curtained Red Flags, and a real rush hour, mixing the ever increasing number of bicycles with official and private cars, trucks, and three-horse wagons bringing vegetables and meat from market oriented farmers into town for good profit. The blue Mao outfit becomes more and more the business dress of cadres and business executives or the clothing of the less fortunate; fabric and style indicate the precise social rank of the wearer. PurposeThis paper scrutinizes the impact of socioeconomic, political, legal and religious factors on the internal ethical values of human rights organizations worldwide. The authors aim to examine the Code of Ethics for 279 HROs in 67 countries and the social and legal settings in which they operate.Design/methodology/approachUsing the framework of protect, respect and remedy, the authors look for keywords that represent the human rights lexicon in these three areas. In the protection of human rights, the authors select the terms: peace, (...) transparency, freedom and security. For the respect of humans, the authors use the terms: dignity, equality, respect and rights. Sources of remedies come from justice and ethics. The analysis seeks to determine what political economy settings drive the ethical value choices of the organizations. Those choices are proxied by those keywords they mention in their Code of Ethics.FindingsThe analysis show that the scope of ethical values mentioned are higher when the HRO is in a country with more domestic violence, lower income inequality, French civil or Islamic legal origin and higher trust in politicians. In regard to the determinants of the ten keywords individually, the authors conclude that the status of the socioeconomic, political, religious and legal settings impact with local HROs mention each of the keywords: peace, justice, transparency, dignity, equality, ethics, respect, freedom, security and rights.Research limitations/implicationsThe analysis is based on HROs that have a webpage in English and list the employee Code of Conduct.Originality/valueThis study is the first to examine the Code of Ethics for HROs. Zoals bekend is de verhouding tussen filosofie en politiek problematisch. De veroordeling van Socrates door de polis maakte diepe indruk op zijn leerling Plato. Mede om dit soort misstappen te voorkomen ontwierp deze een ideale staat waarin filosofen koningen moesten worden. Vanuit dit idee probeerde hij ook Dionysus, de heerser van Syracus, tot een wijsgerig verantwoorde politiek te brengen. De mislukking van dit Siciliaans avontuur heeft velen na hem ervan overtuigd dat filosofen zich beter niet in kunnen laten met politieke (...) besluitvorming. Immers, Plato’s poging om Dionysus tot een wijsgerig verantwoorde politiek te brengen strandde jammerlijk. Maar, filosofen zijn natuurlijk hardleers en de aantrekkingskracht van het rijk der mensen en dingen op hen, die zich zo thuisvoelen in het rijk der ideeën valt niet altijd te loochenen. Hoewel voor Plato de politieke arena van alledag wezenlijk ongeschikt bleek te zijn voor filosofische uiteenzettingen, heeft toch zijn leerling en collega Aristoteles zich nog korte tijd met het onderwijs aan de jonge Alexander de Grote bemoeid – hoewel Aristoteles’ ambities al bescheidener waren dan van Plato. Het verhaal wil zelfs, dat Alexander op diens veldtochten een exemplaar van het werk van Homerus met aantekeningen van Aristoteles erin bij zich droeg. Na de dood van Alexander werd de anti-Macedonische atmosfeer in Athene voor Aristoteles zodanig bedreigend dat hij de stad verliet, om te voorkomen ‘dat de polis zich ten tweede male aan de filosofie bezondigde.’ Wie wel in het lot van Sokrates heeft moeten delen, is Thomas More, de auteur van het in 1516 verschenen ‘Utopia’. More weigerde Henry VIII als hoofd van de kerk te erkennen en moest dat met zijn dood bekopen. Dit vonnis vloeide dus niet direct voort uit het boek waarmee More zo bekend zou worden. Wellicht had More geleerd van de eerdere moeizame betrekkingen tussen filosofie en politiek en had hij daarom besloten om zich over ‘Ou-topia’ of ‘Nus-quama’ te buigen: over niet-plaats of nergens. Het in dialoogvorm opgetekende reisverhaal gaf op indirecte wijze kritiek op het Engeland van zijn tijd. Waarschijnlijk nog belangrijker dan het vermijden van risico’s door het schrijven over een niet reëel bestaande samenleving was het voordeel dat More op die manier een geheel ander beeld van een samenleving kon opstellen en beschrijven – ongehinderd door contingente omstandigheden, praktische bezwaren of politieke obstakels. More sloot de dialoog in ‘Utopia’ af met een korte overweging, waarin de auteur zegt zich nauwelijks te kunnen voorstellen dat deze samenleving ergens gerealiseerd zou kunnen worden. Vele lezers hebben deze overweging echter niet gezien of serieus genomen, zodat er al snel een ernstig meningsverschil over het genre van de utopie ontstond: vormde een utopie een blauwdruk voor een ideale samenleving die zonder meer ingevoerd zou moeten worden, of moest de utopie veeleer gelezen worden als een mengvorm van kritiek en ideaal – kritiek op de bestaande samenleving en richtinggevend ideaal voor nastrevenswaardige veranderingen van de huidige samenleving? We say that the Bush administration knew that no weapons of mass destruction were found in Iraq, that the philosophy department believes its hiring decision complies with employment law, or that we know that greenhouse gas emissions cause climate change. Collective epistemology studies the nature of collective belief, justification, and knowledge. This volume contains ten original articles, five of which are centrally concerned with collective epistemology so understood. Men kan op diverse wijzen filosofische concepten op literaire werken toepassen, zij het dat niet alle wegen even vruchtbaar of adequaat afgelegd werden. In dit essay zal daarvan een overzicht gegeven worden en een voorstel voor een verantwoorde wijsgerige benadering van literatuur gedaan worden. Ten slotte zal deze werkwijze aan de hand van een voorbeeld geconcretiseerd worden.

Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

Symptom Checker Applications (SCA) are mobile applications often designed for the end-user to assist with symptom assessment and self-triage. SCA are meant to provide the user with easily accessible information about their own health conditions. However, SCA raise questions regarding ethical, legal, and social aspects (ELSA), for example, regarding fair access to this new technology. The aim of this scoping review is to identify the ELSA of SCA in the scientific literature. A scoping review was conducted to identify the ELSA (...) of SCA. Ten databases (e.g., Web of Science and PubMed) were used. Studies on SCA that address ELSA, written in English or German, were included in the review. The ELSA of SCA were extracted and synthesized using qualitative content analysis. A total of 25,061 references were identified, of which 39 were included in the analysis. The identified aspects were allotted to three main categories: (1) Technology; (2) Individual Level; and (3) Healthcare system. The results show that there are controversial debates in the literature on the ethical and social challenges of SCA usage. Furthermore, the debates are characterised by a lack of a specific legal perspective and empirical data. The review provides an overview on the spectrum of ELSA regarding SCA. It offers guidance to stakeholders in the healthcare system, for example, patients, healthcare professionals, and insurance providers and could be used in future empirical research to investigate the perspectives of those affected, such as users. Recent findings indicate that the constituting digits of multi-digit numbers are processed, decomposed into units, tens, and so on, rather than integrated into one entity. This is suggested by interfering effects of unit digit processing on two-digit number comparison. In the present study, we extended the computational model for two-digit number magnitude comparison of Moeller, Huber, Nuerk, and Willmes (2011a) to the case of three-digit number comparison (e.g., 371_826). In a second step, we evaluated how hundred-decade and hundred-unit compatibility effects (...) were moderated by varying the percentage of within-hundred (e.g., 539_582) and within-hundred-and-decade filler items (e.g., 483_489). From the results we predict that numerical distance as well as compatibility effects should indeed be modulated by the relevance of tens and units in three-digit number magnitude comparison: While in particular the hundred distance effect should decrease, we predict hundred-decade and hundred-unit compatibility effects to increase with the relevance of tens and units. The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. Das vorliegende Buch verbindet die kritische Neuedition eines spätbyzantinischen, von dem Priestermönch Matthaios verfaßten Gedichtes in 153 byzantinischen Fünfzehnsilbern über die Stadt Theodoro (Θεοδωϱώ), russisch Feodoro, auf der Krim, teilweise als Dialog zwischen dem als Fremder (ξένος) bezeichneten Verfasser und der personifizierten Stadt gestaltet, mit einer ausführlichen historischen Abhandlung über die Geschichte der Krimgoten, die sich einschließlich einiger Ergänzungen (дοδавления) über die Seiten 8–282 und 311–398 erstreckt, also den bei weitem umfangreicheren Teil des Buches ausmacht. In einem näheren Zusammenhang mit (...) dem Gedicht stehen allerdings nur die Passagen der Abhandlung, die sich auf seinen geschichtlichen Hintergrund beziehen. Beyer sagt selbst, daß eine „humane Verpflichtung“ (гуманньй дοлг) gegenüber dem Volk, dessen Zentrum die Stadt Theodoro gemäß der Überlieferung war, ihn genötigt habe, sich über die Edition der besagten Quelle hinaus mit diesem Gebiet zu beschäftigen. Doch ist der Titel (Geschichte … als Interpretation …) nicht glücklich gewählt, weil die Abhandlung als Interpretation des Gedichtes zu weit greift. Andererseits geht die Erläuterung der historischen Aspekte des Gedichtes, die der Leser natürlich vor allem erwartet, in dieser weitläufigen Gesamtdarstellung fast unter. (shrink)

Introduces contemporary American philosophy of technology through six of its leading figures. On 27 September 1943, Hans-Georg Gadamer published a brief but significant article in the conservative newspaper Leipziger Neueste Nachrichten und Handels-Zeitung, entitled ‘Wissenschaft als Beruf. Über den Ruf und Beruf der Wissenschaft in unserer Zeit’ (Science as Vocation: On the Calling and Profession of Science in Our Time). The article, which addressed the problem of the value and status of science and philosophy in the midst of the Second World War, was never reprinted in Gadamer’s work, neither in the (...) ten volumes of his collected writings published by Mohr Siebeck, nor separately in books or journals. I offer here a critical introduction to the context and main contents of this text due to its philosophical, political, and historical relevance. In particular, the introduction analyses Gadamer’s confrontation with his own time through explicit and implicit references to Max Weber’s 1917 lecture, ‘Wissenschaft als Beruf’ (Science as Vocation), and traces echoes in Gadamer’s later works that bear on contemporary challenges. Following that, I present the first English translation of Gadamer’s original German text. (shrink)

Since the beginning of the 20th century, philosophers of science have asked, "what kind of thing is a scientific theory?" The logical positivists answered: a scientific theory is a mathematical theory, plus an empirical interpretation of that theory. Moreover, they assumed that a mathematical theory is specified by a set of axioms in a formal language. Later 20th century philosophers questioned this account, arguing instead that a scientific theory need not include a mathematical component; or that the mathematical component need (...) not be specified by a set of axioms in a formal language. We survey various accounts of scientific theories entertained in the 20th century -- removing some misconceptions, and clearing a path for future research. (shrink)
